Plouffe: Dems Must Rebut GOP's Tax-Hike Message

One day after President Obama warned that viewing the Supreme Court's health care decision through a political lens is "completely missing the point," his top political adviser encouraged congressional Democrats in a memo to do just that.

David Plouffe, Obama?s senior adviser and his campaign manager in 2008, rebutted Republicans? criticisms that the president was raising Americans? taxes as part of the Affordable Care Act. The GOP tax-hike analysis is being pinned to the court?s ruling Thursday that the health law is constitutional in part because the penalty imposed if Americans do not carry health insurance is akin to a tax.

?Republicans in Washington are trying to deliberately misrepresent the president?s record of cutting taxes for the middle class,? Plouffe told congressional Democrats in a memo titled ?Winning the Middle Class Tax Battle.? He accused Republicans of ginning up a debate about higher taxes under Obama when the data refute GOP assertions, he said.

?We urge you to go on offense to illustrate how the president and Democrats in Congress are standing up for the middle class,? he wrote in the two-page memo released by the White House Friday afternoon.

Plouffe?s public protest memo is a defensive ploy the White House hopes it can transform into an offensive play when House Republicans return from the Fourth of July break. House conservatives have said they will vote on July 11 to repeal the 2010 health reform law. That effort is just for show -- the law cannot be changed without cooperation from the Democratic-controlled Senate -- but a political fight this summer in which Republicans accuse Obama of raising taxes lets the two sides mobilize their respective bases.

?Republicans in Congress have voted to preserve tax breaks for big oil and cut taxes for millionaires by 25%,? Plouffe wrote, ?and they?ll pay for that by ending Medicare as we know it and raising taxes for the middle class.?

White House talking points crafted to help ?drive? the debate this weekend and in the coming months, Plouffe said, include the following arguments:

-- The Affordable Care Act provides an average $4,000 tax cut for more than 18 million middle-class people and their families;

-- The penalty imposed as part of the insurance mandate, described by Chief Justice John Roberts as functioning like a tax, was modeled on Mitt Romney?s health care law in Massachusetts, and is estimated by the Congressional Budget Office to impact 1 percent of the population;

-- The ACA should be ?improved? as it is implemented through 2014, and the administration wants to give states more ?flexibility?;

-- Obama has signed laws to cut taxes by $3,600 for an average middle-class family. The GOP wants to raise taxes on the middle class and give millionaires and billionaires a tax cut worth $250,000, Plouffe wrote.

The White House asserts that Obama has the better ?vision? compared to Romney regarding middle-class concerns, including taxes. The president will have a chance to discuss tax reform and a ?balanced? approach to deficit reduction with voters through the summer and fall.

A report released June 20 by Congress? Joint Economic Committee found that the House Republican budget plan authored by Rep. Paul Ryan of Wisconsin, which has been generally endorsed by Romney, would benefit the wealthy over the middle class. The richest 0.1 percent of taxpayers would receive an estimated tax cut of $1.18 million per taxpaying household in 2015, the report found. The Ryan budget plan would raise taxes on those earning less than $200,000 annually by eliminating tax breaks and exclusions now in place, it also said.

Euro 2012: Italy victorious over Germany, now faces Spain in final

Euro 2012: Italy beat Germany, 2-1, in the semifinals of the Euro 2012 soccer tournament. Mario Balotelli scored twice. Italy will face Spain on Sunday the European Championship finals.

?Mario Balotelli finally showed some quality finishing, scoring twice Thursday to give Italy a 2-1 win over Germany and an unexpected spot in the European Championship final.

Extending its winless streak against Italy in major tournaments to eight matches, Germany had no answer for Balotelli nor Antonio Cassano's creativity.

In the 20th minute, Balotelli had no trouble getting past Holger Badstuber to head in a pinpoint cross from Cassano. Then in the 36th, the 21-year-old striker received the ball behind the defense and blasted a long shot into the top right corner.

While he did score against Ireland, Balotelli was criticized for wasting numerous chances against Spain, Croatia and England.

Germany failed to trouble Italy for much of the match, but Mesut Oezil scored on a penalty kick in injury time after Federico Balzaretti was whistled for a handball.

Italy will face defending champion Spain in Sunday's final in Kiev, Ukraine ? a rematch of their 1-1 draw that opened Group C.

While Italy has won four World Cups, it's only European Championship came in 1968. Like when they won the 1982 and 2006 World Cups, the Azzurri have managed to maintain their focus despite a match-fixing and betting scandal at home.

On a pleasant evening at the National Stadium Warsaw, Cassano set up the opening goal by befuddling Germany defenders Mats Hummels and Jerome Boateng to lift the ball in Balotelli's direction.

The second goal began with a long vertical pass from Riccardo Montolivo, whose mother is German. Balotelli collected the pass with his back to the goal, controlled the ball with his chest and then sprinted forward and unleashed a blazing shot from the edge of the area as Germany goalkeeper Manuel Neuer again stood immobile.

Balotelli took off his jersey after his second goal, which drew an automatic yellow card, although he will not miss the final.

Even before scoring, Italy controlled the pace of the match, although Germany did have several chances from Hummels, Toni Kroos and Oezil.

In the 35th, Italy goalkeeper Gianluigi Buffon preserved the Azzurri lead by swatting away a long shot from Sami Khedira ? and Balotelli doubled the lead a minute later.

To start the second half, Germany coach Joachim Loew brought on Miroslav Klose for Mario Gomez at center forward and replaced Lukas Podolski with Marco Reus on the wing.

With Germany appearing slightly more organized, captain Philipp Lahm had a great look at the goal in the 49th but shot way over the bar.

Buffon made another impressive save in the 62nd, leaping to push a free kick from Reus off the bar.

While Italy largely sat back and protected its lead in the second half, the Azzurri did produce some dangerous counterattacks. Claudio Marchisio shot just wide in the 67th and 75th and substitute Antonio Di Natale missed another chance in the 82nd.

Di Natale came on in the 70th after Balotelli went down with a cramp to his left leg.

White-clad German fans greatly outnumbered Italian supporters, unveiling a huge banner before kickoff that featured a giant "G'' for Germany. However, most of the stadium was filled with Polish fans who supported Italy.

They had plenty to cheer about.

Seeking Justice: Jailed Rape Victim Who Was Denied Contraception Can Sue Florida Sheriff

In January 2007, a Tampa, Fla., woman identified in court records as ?R.W.? was raped.

After visiting a rape crisis center in Tampa, she was prescribed emergency contraception as a precaution. She took one contraceptive pill immediately and intended to take a second pill 12 hours later as a doctor had instructed, court records said.?

But R.W. almost didn?t get to take that second pill. In the process of filing a report on the rape, a Tampa police officer discovered that there was an arrest warrant for R.W. She was taken to jail, and everything she had with her was confiscated ? including her pill.

The next morning, R.W. asked permission to take the second pill but was denied by jail employee Michele Spinelli because it conflicted with Spinelli?s religious beliefs. It was only when R.W. was about to be released that she was able to take the contraception, the court said.

Luckily R.W. didn?t get pregnant, but she sued both Spinelli and Hillsborough County Sheriff David Gee for gender discrimination, violation of privacy and denial of equal protection.

Initially, U.S. District Judge Elizabeth A. Kovachevich said that R.W. could sue Spinelli only, dismissing claims against Gee in his official capacity. But R.W. amended her complaint against the sheriff, and earlier this month Kovachevich sided with the plaintiff.

Gee claimed that R.W. didn?t allege any sort of unconstitutional official policy or practice of the county that led to her being denied contraception. Kovachevich disagreed, saying that even though Gee didn?t instruct Spinelli to deny contraception, Spinelli became the official policy maker because Gee wasn?t on duty at the time and he had never taken a stand on access to contraception.

?The single action of a final policy-maker can represent official government?policy, even when the action is not meant to control later decisions....,?? Kovachevich said in her decision. ?

While it is indeed fortunate that R.W. is allowed to move forward with her lawsuit, her ordeal is a glimpse into the future that all Americans may face if the Catholic hierarchy and its Religious Right allies get their way.

The bishops and their fundamentalist cronies argue that their ?conscience? should never be violated, and no one who objects to birth control should ever have to provide it (or allow it to be taken). They don?t care where you work, whether it?s a church, a government agency or a Taco Bell. Your personal religious beliefs trump what anyone else needs or wants ? or what the law says.

They?re wrong. No one should be denied access to health care just because it violates someone else?s religious belief, especially when it?s a government official who is doing the denying.

If ultra-conservative religious lobbies get their way, however, stories like R.W.?s will become all-too-common. This must not happen, and the Obama administration and other elected officials need to stand up to Religious Right bullying.

How flu can cause severe infections

ScienceDaily (June 28, 2012) ? Scientists have discovered a new gene in the influenza virus that helps the virus control the body's response to infection.

Although this control is exerted by the virus, surprisingly it reduces the impact of the infection.

The findings will help researchers better understand how flu can cause severe infections, as well as inform research into new treatments.

Researchers found when the virus gene -- called PA-X -- was active, mice infected with flu subsequently recovered.

When the PA-X gene did not work properly, the immune system was found to overreact. This made the infection worse, and did not help destroy the virus any quicker.

The study looked at how the gene affected the behaviour of "Spanish flu," a virulent strain of influenza that caused a pandemic in 1918.

It was carried out by the Universities of Cambridge, Cork, Edinburgh and Utah, the Institute of Systems Biology in Seattle and the United States National Institutes of Health.

Scientists discovered the PA-X gene some 30 years after flu genome was first decoded.

Professor Paul Digard, of The Roslin Institute at the University of Edinburgh, said: "Just finding this gene in the first place is important, but the find is even more significant because of the role it seems to play in the body's response to flu."

The researchers, whose study is published online in the journal Science, found the hidden gene by analyzing patterns of changes in the genetic information of thousands of different flu strains.

Dr Andrew Firth, of the University of Cambridge, said: "The flu virus has a very, very small genome -- just 12 genes. Finding a new gene makes a pretty significant change to our understanding of this virus."

(AP) ? A European court on Wednesday upheld most of a massive fine levied against Microsoft by the European Commission's competition watchdog, closing a case against the software giant that began in 1998.

In an appeals ruling, the General Court of the European Union rejected Microsoft Corp.'s request to dismiss the fine levied in 2008, but did trim it by ?39 million to ?860 million ($1.1 billion). Counting two earlier fines, the case has wound up costing Microsoft a grand total of ?1.64 billion.

That's the most ever resulting from a single antitrust case in Europe, though in 2009 Intel Corp. was hit with the largest single fine, ?1.09 billion.

The court in Luxembourg said its decision "essentially upholds the Commission's decision and rejects all the arguments put forward by Microsoft in support of annulment."

The ?860 million fine is a "penalty for noncompliance" with the watchdog's 2004 order for Microsoft to make computer programming code available that would allow competitors' products to interface properly with Microsoft's server software.

Microsoft did so, but at a price the Commission said was so exorbitant it amounted to not complying.

The court upheld that finding, but said Microsoft deserved a small break because of a letter the Commission sent in 2005 saying the company didn't have to freely distribute code that wasn't its own and was freely available elsewhere. That letter gave Microsoft some room to think it was okay to continue acting the way it had until 2004, and should have been "taken into account in determining the gravity of the conduct found to be unlawful," the written decision said.

The Commission's top regulator Joaquin Almunia said the judgment "fully vindicates" his office's action against Microsoft and "brought significant benefits to users."

"A range of innovative products that would otherwise not have seen the light of day were introduced on the market," thanks to the Commission, he said.

Microsoft was less enthusiastic.

"Although the General Court slightly reduced the fine, we are disappointed with the Court's ruling," the company said in a statement.

Microsoft was initially fined ?497 million along with the 2004 order, then it was penalized another ?280.5 million for noncompliance in 2006, and then another ?899 million in 2008.

The company has already booked provisions for all the fines and penalties and after the ruling it has no active outstanding quarrels with European regulators.

"In 2009 Microsoft entered into a broad understanding with the Commission that resolved its competition law concerns," the company said.

Most notably in the 2009 deal, Microsoft ended an investigation into allegedly abusive practices for bundling its Internet Explorer web browser along with its operating systems. Microsoft agreed to instead offer customers a range of browsers to choose from.

In a sign of the times, Microsoft itself turned to the watchdog in 2012, asking it to investigate Google Inc. for anticompetitive practices. Microsoft alleged that Google was demanding unreasonable fees to license its technologies and asking courts to pull Microsoft products from shelves if they don't pay up. Google shot back with a similar request for the Commission to again investigate Microsoft last month.

Many observers say companies such as Apple Inc., Google and Microsoft are increasingly acting as "patent trolls," using the legal and regulatory systems as tools to thwart competitors as part of their wider struggle for market share.

Prenatal exposure to common household chemical, phthalate, increases risk for childhood eczema

ScienceDaily (June 26, 2012) ? Prenatal exposure to a ubiquitous household chemical called butylbenzyl phthalate (BBzP) can increase a child's risk for developing eczema, according to research conducted at the Columbia Center for Children's Environmental Health at the Mailman School of Public Health.

Widely used in vinyl flooring, artificial leather and other materials, BBzB can be slowly released into air in homes.

Details are published in the advance online edition of Environmental Health Perspectives, a journal of the National Institute of Environmental Health Sciences.

Eczema, which is characterized by dry, itchy red skin on the face, scalp, or extremities, is common in early childhood. "While hereditary factors, allergens, and exposure to tobacco smoke are known to contribute to the condition, our study is the first to show that prenatal exposure to BBzB is a risk factor," says Allan C. Just, PhD, first author on the Mailman School study and currently a postdoctoral researcher at the Harvard School of Public Health.

The study looked at 407 nonsmoking African-American and Dominican women and their children in New York City. Exposure to BBzB was measured through a urine test during the third trimester of pregnancy. Following birth, the mothers were asked if their child had been diagnosed with eczema. The result: onset of eczema by age 2 was 52 percent more likely in children whose mothers had been exposed to higher concentrations of BBzP, compared with those whose mothers had been exposed to lower concentrations. All but one of the women in the study showed some level of exposure to the chemical.

How BBzP might induce eczema remains murky. To explore that question, the researchers looked at allergies as a possible mechanism. Children were tested for three common indoor allergens: cockroaches, dust mites, and mice, as well as for total IgE, a biomarker for an immune response to all allergens. But they found no evidence of a link between BBzP exposure and allergy.

"We know allergies are a factor with some childhood eczema, but our data suggest that is not the case when BBzP is involved," says senior author Rachel Miller, MD, Director of the Allergy and Immunology fellowship program and Associate Professor of Medicine (in Pediatrics) and Environmental Health Sciences, NewYork-Presbyterian Hospital/Columbia University Medical Center; and a Co-Deputy Director of the Columbia Center for Children's Environmental Health. "However, these are important findings, given that eczema is a common and uncomfortable disease of early childhood."

The researchers also found that while African-American mothers in the study were twice as likely as their Dominican-American counterparts to report that their child had been diagnosed with eczema, both groups had a similar association between BBzP exposure and the disease.

Previous research by study co-author Robin M. Whyatt, DrPH, Professor of Clinical Environmental Health Sciences and Co-Deputy Director of the Columbia Center for Children's Environmental Health, found that exposure to BBzP and other phthalates was shown to delay motor skill development in young children and to increase risk for behavioral problems. Phthalates are also known to disrupt the body's endocrine system.

(AP) ? Would you go to a drugstore to get tested for AIDS?

Health officials want to know, and they've set up a pilot program to find out.

The $1.2 million program will offer free rapid HIV tests at pharmacies and in-store clinics in 24 cities and rural communities, the Centers for Disease Control and Prevention announced Tuesday.

Drugstores now offer blood pressure checks, flu shots and a few other types of health services. Officials are hoping testing for the AIDS virus will become another routine service.

"By bringing HIV testing into pharmacies, we believe we can reach more people by making testing more accessible and reduce the stigma associated with HIV," CDC's Dr. Kevin Fenton said in a statement. He oversees the agency's HIV prevention programs.

The tests are already available at seven places, and the CDC will soon pick 17 more locations.

The HIV test is a swab inside the mouth and takes about 20 minutes for a preliminary result. If the test is positive, customers will be referred to a local health department or other health-care providers for a blood test to confirm the results, counseling and treatment.

When the project ends next summer, CDC officials will analyze what worked well and what didn't, said Paul Weidle, the epidemiologist who is heading up the project.

An estimated 1.1 million Americans are infected with HIV, but as many as 20 percent of them don't know they carry the virus, according to the CDC. It can take a decade or more for an infection to cause symptoms and illness.

Since 2006, the CDC has recommended that all Americans ages 13 to 64 get tested at least once, not just those considered at highest risk: gay men and intravenous drug users.

On special occasions, health organizations have sent workers to some drugstores to offer HIV testing. This week, Walgreens ? the nation's largest chain of pharmacies ? is teaming with local health departments and AIDS groups to offer free HIV testing at stores in 20 cities.

But this CDC pilot program is different: It's an effort to train staff at the pharmacies to do the testing themselves, and perhaps make it a permanent service.

"I'm excited. It's such a new and novel thing for us," said Sarah Freedman, who manages a Walgreens in Washington, D.C., that is participating in the pilot program.

At her pharmacy, the testing is done in a private room. They've also taken steps to make sure that a customer can very quietly request the test. For example, they've put out stacks of special test request cards ? they look like business cards ? at George Washington University and other nearby businesses. Anyone seeking a test can simply hand the card to the clerk, she said.

Only three or four customers have gone through with a test in the first few weeks.

"We get a lot of questions," she said. "Usually they get the information and they go and sit on it and think about it."

There's a second Walgreens in Washington offering the test, as well as branches in Chicago and Lithonia, Ga. Other test sites: East Pines Pharmacy in Riverdale, Md., Mike's Pharmacy in Oakland, Calif. and a federal Indian Health Service location in Billings, Mont.

Each of the locations will get enough tests to check 200 to 300 people.

Garmin Swim watch tracks your water workouts, we hit the pool

Garmin is adding a new product to its line-up of fitness watches, and this one is dedicated to workouts of the aquatic variety. The Garmin Swim tracks your distance swam, average pace, workout time and more, and it uploads those stats to the web to help monitor your progress. Though it's meant to be a part of your exercise routine, the Garmin Swim watch looks like your average plastic digi-timepiece. The watch has six buttons with functions for viewing the time of day, scrolling through the menu options, controlling the timer, viewing the menu and entering workout mode. The setup takes some getting used to, but the illustrative icons on the watch helped us get into the rhythm quickly.

Getting started with the Swim simply entails entering the size of your pool, with options to measure in yards or meters. Once that info is uploaded, you press the swim button and are ready to get splashing. We spent a solid half-hour doing laps, and the Swim duly recognized and recorded that we varied our strokes. Stopping the timer each time we took a break created a new interval for our workout, with a rundown of the elapsed time, distance in meters, number of strokes, type of stroke, total laps, average speed and calories burned. That's a lot of data to pore over, and Garmin lets you wirelessly upload it all to the Garmin Connect site. To do this, you have to pair the watch with your computer using a USB ANT stick: once it works, it's an efficient, easy way to review your workout, but it took us a few tries before our laptop recognized the watch. Garmin says the watch's battery will last a full year, which is plenty of time to log some serious laps. For more about the Swim, check out the press info past the break.

Illinois fugitives arrested in New Mexico

ALBUQUERQUE, N.M. (AP) -- A manhunt that began with a deadly shooting in Illinois ended Saturday in the eastern New Mexico city of Tucumcari.

The U.S. Marshals Service arrested 20-year-old Carlton Neely and 22-year-old James Edward Johnson outside a truck stop early Saturday morning without incident after spotting one of the men buying food inside.

Murder warrants were issued for the men on June 15 in Illinois after the Marshals Service said the two men shot at least four people, killing one.

The Marshals Service said the pair fled to California, and investigators were able to track them to Arizona and then New Mexico.

After authorities combed Tucumcari area hotels for the men, a deputy saw Edwards buying food at a truck stop and notified his colleagues outside.

They're awaiting extradition back to Illinois.
